Please read these terms of use carefully. If you do not agree to these terms and/or our privacy policy, you must not use our site. Your use of the Doughpad through the Site is deemed your acceptance of these terms, and by accessing or using our services and software, you (“you”, “your”, or “customer”) agree to be bound by these terms of use and all terms incorporated by reference. These terms of use are entered into by and between you and Dough ("Doughpad", "Dough", "Doughbsc", "our", "we", or "us"). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these "Terms of Use" or “Terms of Service”), govern your access to and use of doughpad.com and docs.doughpad.com, including any content, functionality and services (“Services”) offered on or through doughpad.com and docs.doughpad.com (together, the "Website" or “Site”). These Terms of Use may be amended, changed, or updated by Dough at any time and without prior notice to you. Your non-termination or continued use of any Services after the effective date of any amendments, changes, or updates constitutes your acceptance of these Terms of Service, as modified by such amendments, changes, or updates. The use of the Site and any Services is void where such use is prohibited by, would constitute a violation of, or would be subject to penalties under applicable Laws, and shall not be the basis for the assertion or recognition of any interest, right, remedy, power, or privilege.

Rights & Obligations

We reserve the following rights, which do not constitute obligations of ours: (a) with or without notice to you, to modify, substitute, eliminate or add to the Doughpad; (b) to review, modify, filter, disable, delete and remove any and all content and information from the Doughpad; and (c) to cooperate with any law enforcement, court or government investigation or order or third party requesting or directing that we disclose information or content or information that you provide.
We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
Our site is made available free of charge.

Third Party Liability

The Site may contain links to third party products, services, and websites. We exercise no control over the third party products, services, and websites and we are not responsible for their performance, do not endorse them, and are not responsible or liable for any content, advertising, or other materials available through the third party products, services, and websites. We are not responsible or liable, directly or indirectly, for any damage or loss caused to you by your use of or reliance on any goods or services available through the third party products, services, and websites. Additionally, if you follow a link or otherwise navigate away from the Site, please be aware that these Terms will no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any third party websites to which you navigate to from the Site.

Onramper

By making use of the Onramper integration the Terms of Use and/or Privacy Policy of onramper.com may apply. Doughpad is in no way involved in the processing of your personal data and/or transaction when using Onramper. For support or complaints please visit onramper.com.
To the widest extent permitted by law Doughpad shall not be a party to nor responisble for any matter arising out of or in connection with your entering into an agreement with Onramper including any transaction made pursuant to the agreement between you and Onramper

Non-Solicitation; No Investment Advice, No Financial Advice

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.
You agree and understand that all trades you submit through the Interface are considered unsolicited, which means that you have not received any investment advice from us in connection with any trades, including those you place via any of our API’s, and that we do not conduct a suitability review of any trades you submit. All information provided by the Interface is for informational purposes only and should not be construed as investment or financial advice. You should not take, or refrain from taking, any action based on any information contained in the Interface. We do not make any investment recommendations to you or opine on the merits of any investment transaction or opportunity. You alone are responsible for determining whether any investment, investment strategy or related transaction is appropriate for you based on your personal investment objectives, financial circumstances, and risk tolerance.
Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.

Not Registered with the SEC or Any Other Agency

We are not registered with the U.S. Securities and Exchange Commission as a national securities exchange or in any other capacity. You understand and acknowledge that we do not broker trading orders on your behalf nor do we collect or earn fees from your trades on the Covenant. We also do not facilitate the execution or settlement of your trades, which occur entirely on the public distributed BSC blockchain or through Third Party providers.

Intellectual property

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organization to content posted on our site. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Assumption of Risk

By accessing and using the Doughpad, you represent that you are financially and technically sophisticated enough to understand the inherent risks associated with using cryptographic and blockchain-based systems, and that you have a working knowledge of the usage and intricacies of digital assets such as bitcoin (BTC), ether (ETH), Smart Chain (BNB) and Doughpad (DOUGH) and other digital tokens such as those following the Ethereum Token Standard (ERC-20) or Binance Token Standard (BEP-20). In particular, you understand that blockchain-based transactions are irreversible. You further understand that the markets for these digital assets are highly volatile due to factors including (but not limited to) adoption, speculation, technology, security, fundamental events and regulation. You acknowledge and accept that the cost and speed of transacting with cryptographic and blockchain-based systems such as the BSC are variable and may increase dramatically at any time.
You further acknowledge and accept the risk that your digital assets may lose some or all of their value, you may suffer loss due to the fluctuation of prices of tokens in a trading pair or liquidity pool, and experience significant price slippage, taxes and costs. You understand that anyone can create a token using the Token Creator, including fake versions of existing tokens and tokens that falsely claim to represent projects, and acknowledge and accept the risk that you may mistakenly trade those or other tokens. You further acknowledge that we are not responsible for any of these variables or risks, do not own or control the Smart Contract after deployment, and cannot be held liable for any resulting losses that you experience while accessing or using the Doughpad. Additionally you understand Tokens created using the Token Creator have built-in safety mechanisms such as audited contracts, KYC verified Owners and three (3) months locked Liquidity Pools, but Doughpad can and does not guarantee in any way the success or legitimacy of the project and therefore the profitability of your investement. Accordingly, you understand and agree to assume full responsibility for all of the risks of trading on, accessing and using the Doughpad and/or Tokens created on Doughpad.

Compliance with Local Laws

It is Users’ responsibility to abide by local laws in relation to the legal usage of Doughpad in their local jurisdiction as well as other laws and regulations applicable to Users. Users must also factor, to the extent of their local laws, all aspects of taxation, the withholding, collection, reporting and remittance to their appropriate tax authorities. All users of Doughpad acknowledge and declare that their funds come from legitimate sources and do not originate from illegal activities; users agree that Doughpad will require them to provide or otherwise collect the necessary information and materials as per relevant laws or government orders to verify the legality of the sources and use of their funds. Doughpad maintains a stance of cooperation with law enforcement authorities globally and will not hesitate to seize, freeze, terminate Users’ accounts and funds which are flagged out or investigated by legal mandate.

Limitation of Liability

Under no circumstances shall we or any of our officers, directors, employees, contractors, agents, affiliates, or subsidiaries be liable to you for any indirect, punitive, incidental, special, consequential, or exemplary damages, including (but not limited to) damages for loss of profits, goodwill, use, data, or other intangible property, arising out of or relating to any access or use of the Doughpad, nor will we be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Interface or the information contained within it. We assume no liability or responsibility for any: (a) errors, mistakes, or inaccuracies of content; (b) personal injury or property damage, of any nature whatsoever, resulting from any access or use of the Doughpad; (c) unauthorized access or use of any secure server or database in our control, or the use of any information or data stored therein; (d) interruption or cessation of function related to the Doughpad; (e) bugs, viruses, trojan horses, or the like that may be transmitted to or through the Doughpad; (f) errors or omissions in, or loss or damage incurred as a result of the use of, any content made available through the Doughpad; and (g) the defamatory, offensive, or illegal conduct of any third party. Under no circumstances shall we or any of our officers, directors, employees, contractors, agents, affiliates, or subsidiaries be liable to you for any claims, proceedings, liabilities, obligations, damages, losses, or costs in an amount exceeding the amount you paid to us in exchange for access to and use of the Doughpad, or .00, whichever is greater. This limitation of liability applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, and even if we have been advised of the possibility of such liability. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of certain liabilities and damages. Accordingly, some of the disclaimers and limitations set forth in this Agreement may not apply to you. This limitation of liability shall apply to the fullest extent permitted by law.
